Limitation in Civil Matters: Recent Judicial Observations

A summary of recent observations on condonation of delay and computation of limitation periods.

Courts have repeatedly observed that the law of limitation is founded on public policy and that sufficient cause for condonation must be explained for each day of delay.

The computation of the limitation period, the exclusion of time spent in bona fide proceedings before a wrong forum, and the effect of acknowledgement in writing remain frequently litigated questions.
